New Hampshire Negligent Homicide Charges
… and how our Portsmouth criminal defense attorneys can help.
A person is guilty of Class B felony negligent homicide if the person negligently caused the death of another. This includes when someone is killed because of negligent operation of an automobile — which is why negligent homicide charges are often associated with drunk driving cases.
If you are charged with negligent homicide and were allegedly driving under the influence (impaired by drugs, alcohol, or a combination), you face a Class A felony which carries a maximum prison term of 15 years.
Negligent homicide does not actually require the government to prove the person at fault was impaired, however. You can be convicted as long as you can be found criminally negligent. Criminal negligence is different from civil negligence and requires more proof. Attorneys O’Keefe and Reis have both directly fought for clients on this complex issue and are ready to help you.
