We are happy that after several months the State agreed to reduce the driving while impaired (DWI) charge to reckless driving. Not only does this avoid a criminal conviction because reckless driving is a civil infraction and not a crime like DWI, but the client avoided other potential penalties as well. It's important to understand that even though one may not be convicted of a second offense DWI, the DMV may issue a 2-year administrative suspension if the arrest meets their regulations. For example, a second breath or blood test refusal in a 10 year time period will likely result in a 2 year administrative suspension even if the person was never convicted of DWI in court. There are many reasons why folks need an experienced and compassionate DWI attorney including the multiple DMV direct and collateral consequences.
