UNH Students and anyone under age 21 in New Hampshire must be wary of the pitfalls of RSA 179:10. Specifically, Massachusetts residents convicted of this offense will suffer a loss of license from the MA RMV if convicted. This statute was amended in 2011 to remove mandatory license loss, however New Hampshire minors convicted may still suffer a loss of license between 90 days and 1 year for a 1st offense and 6 months and 2 years for a 2nd offense under NH RSA 263:56-b.

In this particular case, a resisting arrest misdemeanor was dismissed and the unlawful possession of alcohol charge was amended to a lesser offense preserving the client's ability to drive. Lastly, be aware that possession may be internal in addition to possessing any container with alcohol.
